Terms of Service

These Terms of Service (the “Terms”) form a binding agreement between you and Luke Lee (“we”, “us”) governing your access to and use of ChiAura, including its website, applications and related services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1Description of the Service

The Service provides Chinese metaphysics content and tools, including BaZi charts, tarot draws, Chinese name suggestions and AI-generated readings, offered for reflection, education and entertainment.

2Eligibility

You must be at least 16 years old to use the Service, and of the age of majority in your jurisdiction to make purchases. By using the Service, you represent that you meet these requirements.

3No Professional Advice; No Reliance

The Service does not provide medical, psychological, legal, financial, investment or other professional advice, and does not predict future events. Content is provided for informational and entertainment purposes only. You are solely responsible for any decision you make, and you agree not to rely on the Service as the basis for decisions concerning health, finances, relationships or other matters of significance. If you are in crisis, contact a qualified professional or your local emergency services.

4AI-Generated Content

Readings are generated by third-party artificial intelligence models from data computed by our engine. Output may be inaccurate, incomplete, inconsistent or unsuitable, and does not represent our views. We do not warrant the accuracy of any content and accept no liability for reliance on it.

5Accounts

You are responsible for maintaining the security of your account and for all activity under it. Each account is for one person and may not be shared, sold or transferred. You must provide accurate information and notify us promptly of any unauthorised use.

6Acceptable Use

You agree not to:

1. use the Service unlawfully or in a way that infringes the rights of others;
2. interfere with, disrupt or overload the Service, or attempt to gain unauthorised access to it or its systems;
3. scrape, crawl, copy or extract content or data by automated means;
4. reverse engineer the Service or attempt to derive its source code, models or prompts;
5. resell, sublicense or commercially exploit the Service or its content;
6. use the Service to develop a competing product or service.

7Credits

Certain features consume credits that are granted daily and reset each day. Credits are a limited, revocable licence, have no monetary value, and cannot be purchased, sold, transferred, exchanged or refunded. We may change credit allocations at any time.

8Subscriptions and Billing

Plus is billed in advance on a monthly or annual basis through Stripe at the price displayed at checkout, inclusive of applicable taxes, and renews automatically until cancelled. You authorise recurring charges to your payment method until you cancel. You may cancel at any time through the billing portal; cancellation takes effect at the end of the current billing period, and access continues until then.

9Refunds

Except where required by applicable law, all payments are final and non-refundable, including for partial billing periods and unused features. Name reports are digital content generated immediately upon purchase; by completing a purchase, you request immediate performance and acknowledge that any right of withdrawal ends once generation begins. Plus does not include name reports.

10Price Changes

We may change prices at any time. Price changes to an existing subscription will be notified by email in advance and take effect from your next renewal; you may cancel before then.

11Intellectual Property

The Service, including its software, engine, written materials, dictionary, artwork, trademarks and the ChiAura name, is owned by us or our licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use the Service, and the content generated for you, for personal and non-commercial purposes. All rights not expressly granted are reserved.

12Your Content

You retain any rights you hold in information you submit. You grant us a worldwide, royalty-free licence to host, store, process and transmit that information as necessary to operate and provide the Service. You represent that you have the right to submit it, including any birth details of other persons. We may use any feedback you provide without restriction or compensation.

13Third-Party Services

The Service relies on third-party services, including payment, authentication, hosting and AI providers. We are not responsible for the availability, content or practices of third-party services, and your use of them may be subject to their own terms.

14Disclaimer of Warranties

To the fullest extent permitted by law, the Service and all content are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation.

15Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to the Service or these Terms. Our total aggregate liability for all claims shall not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim. Where a jurisdiction does not permit certain limitations, they apply to the maximum extent permitted.

16Suspension and Termination

You may stop using the Service and delete your account at any time from the Account page. We may suspend, restrict or terminate your access at any time, with or without notice, if we reasonably believe you have breached these Terms, created risk or legal exposure, or where required by law. We may modify, suspend or discontinue any part of the Service at any time. Provisions that by their nature should survive termination will survive.

17Changes to These Terms

We may revise these Terms from time to time. Material changes will be posted on this page and notified by email. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

18Governing Law and Disputes

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles. Before bringing any claim, you agree to contact us at chiaura2025@gmail.com and to attempt to resolve the dispute informally for at least 30 days. To the extent permitted by law, disputes shall be brought on an individual basis and not as part of any class or representative action. Nothing in these Terms limits any mandatory consumer rights you have under the law of your place of residence.

19General

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver.
